ECS offers many different services to our customers. Most of our services involve processing customer data. The purposes of the processing are determined by our customers and not by ECS which makes the customer the data controller. In such cases, ECS acts as a data processor and processes the data on behalf of the customer. We have laid down the relationship between the Customer as data controller and ECS as data processor for you in our standard Data Pro Statement and this is included in our general terms and conditions. When the Customer acts as a data controller, the Customer must (according to the applicable privacy law), ensure the legal grounds for the processing of the personal data. Furthermore, the customer must assess and determine the risks of data subjects by processing their personal data. Another important aspect of the customer's job as a data controller is to comply with the information obligation towards data subjects.
ECS is a natural part of the Customer's duties as a data controller, in that ECS's services are part of the processing of personal data that the Customer must ensure is in compliance with applicable privacy laws. When ECS processes personal data on behalf of its customers, we must do so in accordance with the privacy laws applicable to data processors.
In short, the Client and ECS are obliged to cooperate to ensure privacy for data subjects. ECS will provide the information necessary for Customer to comply with applicable privacy laws.
ECS uses subcontractors to process personal data and may export your or our data from customers outside the EU in this regard. These subcontractors are typically vendors of software, cloud services or other IT (hosting) services.
When using subcontractors, ECS enters into a data processing agreement (DPA) with subcontractors to protect your privacy rights and fulfill our obligations to our customers. Where subcontractors are located outside the EU, ECS ensures the legal grounds for such international transfers on behalf of you or our customers by relying on Privacy Shield (US) or using the EU Model Clauses.
ECS relies on a few external strategic third parties to support our business processes and deliver our services. A list of our subcontractors is available on request.
